Legal Division

The Legal Division is affiliated with the Dean’s Office and is responsible for supervising all legal matters and cases, providing legal advice, and representing the College of Food Sciences / Al-Shirqat in lawsuits in which the college, in its legal capacity, or one of its staff members is a party. It also participates in internal committees within the college or committees formed at the level of the University of Baghdad that require legal expertise.

The main purpose of establishing the Legal Division is to ensure the proper application of the law in all legal matters accompanying the academic and administrative mission of the educational institution, while also safeguarding the rights of the college’s staff within the framework of the applicable laws governing their employment relationship.

I. The Legal Division

The division supervises all legal tasks and cases, prepares investigative and auditing committees, manages guarantees and authorizations of all kinds, and represents the college in lawsuits before competent courts. The division is subdivided into two units:

  • Legal Consultations Unit

  • Rights and Lawsuits Unit

II. Duties of the Director of the Legal Division

  1. Providing legal opinions and consultations.

  2. Preparing studies on draft laws related to the university and the Ministry of Higher Education and Scientific Research, and providing feedback.

  3. Reviewing contracts related to the college, issuing legal opinions on them, and approving contracts of all kinds.

  4. Representing the college before courts and competent judicial authorities.

  5. Following up on the allocation and distribution of lands and housing units for the college’s staff in coordination with the university / Legal Affairs Department.

  6. Contributing to committees that require legal membership (general inventory of the college – war damages inventory – promotions and allowances – salary determination – Accountability and Justice Committee – Committee of dismissed political staff – liquidation committee – Student Discipline Committee – auction committees – investigative and auditing committees referred to the Legal Division and implementing their recommendations).

  7. Any other tasks assigned to the division.

III. Duties of Staff Working in the Legal Division

  1. Organizing incoming and outgoing correspondence of the division.

  2. Drafting official correspondence related to the college and responding to inquiries from the university and other relevant entities.

  3. Organizing guarantees, authorizations, and commitments related to the division’s work.

  4. Archiving and maintaining the division’s official correspondence.

  5. Preparing all required documents and official records.

  6. Managing guarantees and commitments related to the college, including:

    • Guarantees: (Undergraduate and postgraduate students’ guarantees – staff benefiting from study leave inside Iraq – loan guarantees for academic staff and employees).

    • Staff commitments: (Maternity leave, five-year leave, long-term leaves, marital commitment leave).

    • Student commitments: (Postgraduate and undergraduate).

    • Commitments related to Accountability and Justice procedures.

  7. Handling authorizations for staff to receive salaries.

  8. Issuing clearance certificates for staff in cases of transfer, secondment, or long leave.

IV. Units within the Legal Division

  1. Rights and Lawsuits Unit – represents the college before competent courts.

  2. Legal Consultations Unit – provides legal opinions to the college’s departments and responds to verbal and written legal inquiries.

V. Main Tasks and Responsibilities of the Legal Division

  1. Representing the college before competent courts in all lawsuits (for or against the college), appearing before police stations when necessary, and initiating civil and criminal lawsuits, especially against students involved in forgery (13 lawsuits to date).

  2. Representing the college before the Integrity Commission to document statements against students accused of forgery or falsely claiming graduation from the college.

  3. Reviewing contracts referred to the Legal Division, issuing legal opinions, and approving them.

  4. Following up on cases related to dismissed political staff, notifying them of decisions issued by the Ministry’s Committee and the Cabinet’s Verification Committee, and responding to related communications.

  5. Handling notifications and summonses related to staff, whether from courts, enforcement departments, or other state entities.

  6. Participating in committees, preparing reports, and archiving their records. These include:

    • Investigative committees of all types.

    • Auditing committees.

    • Technical committees.

    • Student Discipline Committee.

    • Student Transfer Committee.

    • Salary Scale Committee.

    • Tender opening and evaluation committee.

    • Committee for assessing damages caused by the rehabilitation of college rooftops.

    • College inventory committee.

    • Auction committee for college sites.

    • State property sales and leasing committee.

    • Promotions committee.

The Legal Division also provides legal consultations to all departments of the college upon request, issues legal opinions, and supplies them with the necessary laws and regulations to support the legal perspective. It also drafts and prints all legal correspondence and maintains copies of official legislation and laws published in the Iraqi Official Gazette.
